Mandatory Union Benefits

The below benefits are required for eligible employees in Brazil based on the rules set forth by the local collective bargaining agreement (CBA) that Remote adheres to. These benefits are unique to Brazil and not reflected in our benefits packages for other countries.

  • All employees who receive a monthly gross salary of 6,499.44 BRL or less (approx. $1,300 USD, annually adjusted) must receive this benefit. These are the most recent requirements as of 2024.
  • If the employee takes sick leave this should be paid for 30 days (but no longer).
  • Payment is still required in the case of PTO, maternity leave, or other absences allowed by law.

Life Insurance

  • This benefit is a social contribution.
  • The employee needs to provide proof of the expenses incurred per child.

Profit Sharing

BRL 300.50/year (approx. $60 USD)

  • Profit sharing is mandatory and must be paid in two installments:
  • 1) BRL 150.25 to be paid from August 31st for the period of January 1st to the 30th of June.
  • 2) BRL 150.25 to be paid by March 30th for the period from July 1st to December 31st.
  • The profit sharing amount to be paid to the employees is determined by union and disclosed to the employers in the updated CBA for the current year, including the payment guidance.
  • If the employer has an internal policy about profit sharing which exceeds the amount agreed upon by the union, the larger amount should be paid to the employee. The amount cannot be decreased.

Transportation Benefits

The amount due is equivalent to what is spent by the employee to commute to their workplace

  • This benefit is only mandatory for employees who are not working from home.
  • The employer should provide a form to be filled out during the employee's onboarding within 48 hours, in which the employee acknowledges and accepts or declines the transportation benefit (based on whether they need or don't need it).
  • If the employee refuses this benefit, they need to explicitly justify it (for instance, “I work from home and won't incur commuting expenses”).

Dental Assistance

BRL 27/mo. (approx. $6 USD)

  • This benefit is now mandatory for all employees in Brazil.
  • Employees can elect to contribute 11.25 from their monthly salary (must be accepted by writing).

Disabled Child Aid

10% of the minimum category salary (as imposed by the union)

  • The employee must provide proof of the disabled child in order to receive this benefit.

Annual Salary Increases

5.97% of the employee's salary

Understanding Hiring in Brazil
  1. Healthcare System: Brazil has both a public and private healthcare system. The public system, known as the United Health System (SUS), is free for all legal residents. The private health system is comprised of private hospitals and clinics, which typically require a deposit from the individual before they can access care. Individuals must then apply to be reimbursed by their private health insurance provider. Many companies offer private health insurance to their employees to allow them to access more specialized care.
  2. 13th Month Salary: In Brazil, workers are entitled to a “13th month salary,” which is essentially a required bonus in an amount equal to one months salary. It is paid out to employees in two parts, in November (by the 20th) and again in December. A pro-rated 13th-month salary is also due upon termination. This payment is a legally mandated benefit and not part of the base salary. During negotiations with candidates, it is important to clearly state what salary amount is being offered and whether or not it is inclusive of the 13th-month payment.
  3. Time Off Requirements: Employees in Brazil are entitled to 30 calendar days of vacation per year after every 12 months of work, and the employee must be paid 1/3rd of a month’s salary as a vacation bonus. Holiday pay and holiday bonus payments are due pro-rated upon termination. If an employee is sick and provides a medical note, the first 15 days of absence must be paid. Any additional days off are paid through the National Institute of Social Security (INSS) at fixed rates. Women are entitled to 4 months of maternity leave and may not be dismissed during pregnancy or during the 12 months after birth. Men are entitled to 5 days of paid paternity leave, which they must request in advance.
  4. Unions in Brazil: Unions in Brazil represent all workers in a given professional category and a respective territory, which may be a city, a region, or a state. Unions and trade associations meet on an annual basis to negotiate the Collective Bargaining Agreement (the “CBA”) applicable to the companies and workers that fall under their domains. Representation is automatic and applies to all employees that fall under the given professional category and territory.
  5. Collective Bargaining (CBA) Benefits: Meal vouchers, grocery cards, life insurance, childcare allowance, profit sharing, transportation benefits, dental assistance, disabled child aid, and health insurance benefits are all MANDATORY benefits for eligible employees in Brazil based on the terms of the local collective bargaining agreement (CBA) that Remote works with. Some of the CBA benefits are only required for employees in certain circumstances. These include the grocery card benefit, which is only for employees who earn less than a certain amount (see threshold above); transportation benefits, which are only for employees who are required to commute; disabled child aid, which is only for employees who can provide proof of a disabled child; and dental assistance, which is only for employees who are based in the city of Sao Paulo, among other benefits as seen in the table above. Remote abides by the CBA rules for the worker’s union known as SINDEEPRES (see more at sindeepres.org.br).
  6. Everyone employed by Remote in Brazil must have access to core benefits as part of their basic compensation package.
