We know intellectual property rights (IPRs) rank among your organisation’s most valuable assets. When staff are based in different countries, confirming clear ownership of IPRs can be difficult. Remote IP Guard follows a seamless two-stage process to provide maximum protection and establish ownership for our clients. The approach is fully transparent, letting you trace the chain of IP transfer from the employee(s) to you.
The IPRs are assigned or transferred from the Employee(s) to the Remote local entity pursuant to: (a) local law – as IP created in the course of employment generally vests automatically in the legal employer; and (b) Remote’s carefully drafted IP documentation which is signed by the employee and the Remote local entity. That documentation is produced and periodically reviewed by qualified lawyers in the employee’s country, and you can always access it directly in our platform.
The IPRs are assigned or transferred from the Remote local entity, which provides employment services, directly to you, the customer, under our Terms of Service. No intra-group transfers take place. We have established and control our employing legal entities in every country where we operate, so you do not have to rely on third parties for IP matters.
As the Employer of Record (EOR), we accept full responsibility for the transfer and provide an indemnity that covers you should anything go wrong.
