What does payroll compliance mean?

Managing payroll across multiple countries is often a complex undertaking, especially for startups and small businesses. For finance leaders, ensuring compliance with payroll requirements in every jurisdiction is vital to prevent legal disputes, financial penalties, and even restrictions on hiring or conducting business.

This checklist outlines the essential steps to maintain payroll compliance across borders.

Below are the main compliance areas to consider when managing international payroll:

Payroll methods and legal considerations

To lawfully compensate employees in different locations, you must implement an appropriate payment method. For example:

1. If you maintain a legal entity in an employee’s country, you may run their payroll in-house or outsource it to a trusted provider.

2. If you don’t have a legal entity in an employee’s country, you can use an employer of record (EOR).

How does a payroll provider differ from an EOR?

In either case, you (or your EOR) must be registered with local tax authorities and other pertinent agencies in every country where your employees are located. In certain jurisdictions, an in-country bank account is also required.

Payroll schedules and frequency

Pay frequency can vary significantly between countries (and, in the US, between states). It’s essential to comply with these local pay schedule laws in each country where you have employees.

For example, some countries mandate bi-weekly pay, whereas others require at least monthly payments. Frequency may also vary by industry.

To prevent non-compliance, make sure you understand these variations and process payroll accordingly.

Statutory benefits and contributions

In many jurisdictions, employers must withhold and contribute to statutory benefits, including social insurance schemes, pension plans, and other compulsory programs.

Make accurate contributions on behalf of your employees to avoid legal consequences and to secure their access to social benefits. Also ensure any required employer-side contributions are made.

Data protection and privacy

Payroll records contain sensitive personal data, and protecting this information is legally mandated. Most countries or regions have specific data protection and privacy laws—such as GDPR in Europe.

Ensure that payroll data is stored securely, encrypted, and otherwise protected, and that your privacy and data-handling procedures comply with the legislation applicable in your employees’ countries.

When calculating salaries, pay careful attention to the employment laws in your employees’ jurisdictions. In particular, be mindful of:

1. Minimum wage requirements. These may differ not only by country but also by state, city, and industry.

2. Overtime regulations. Overtime pay may be required under local labor laws, with significant variation in rates and qualifying conditions.

3. Collective Bargaining Agreements (CBAs). In jurisdictions with CBAs, additional wage requirements may apply to specific sectors or roles.

4. Industry-specific laws. Certain industries may be subject to special regulations that influence wages and benefits.

Withholding and tax deductions

Tax compliance is among the most critical elements of payroll management. For each employee, ensure you withhold and remit the correct income tax, social contributions, and any other applicable taxes.

As part of compliance, familiarize yourself with local income tax rates, thresholds, and any special exemptions across all employee locations.

Payslip distribution and requirements

Each country sets its own rules for issuing payslips, including required contents and acceptable distribution methods.

Ensure each payslip includes all legally required details—such as gross pay, net pay, tax withholdings, and social contributions.

Also note that some jurisdictions require paper payslips, while others permit electronic delivery.

Reporting and record-keeping obligations

Payroll reporting obligations vary by country, but most jurisdictions demand periodic reporting to tax or labor authorities. Many also require employers to retain payroll records for a minimum statutory period.

Implement processes to guarantee accurate, timely payroll reporting and secure retention of records for the required timeframe.

Classifying your team members correctly

When hiring internationally, many startups and small businesses engage independent contractors. If you plan to do so, ensure that you classify those hires correctly.

Each country has its own criteria for distinguishing contractors from employees, and you must comply with those definitions. Failure to do so risks misclassification and potentially substantial fines and penalties.
