Types of leave in Guatemala

Annual leave

Employees are entitled to a minimum of 15 days’ paid leave once they have worked 150 days.

Sick leave

Employees are entitled to paid sick leave. The amount depends on the employee’s length of service, as follows:- Between two and six months: half of the employee’s pay for the first month- Between six and nine months: half of the employee’s pay for two months- More than nine months: half of the employee’s pay for three monthsIf the employee has not recovered by the end of their sick pay entitlement period, the employment contract is suspended. At this stage, the employee may opt to terminate the contract, but the employer can only do so with just cause.

Maternity leave

Employees are entitled to 12 weeks’ paid maternity leave. Note that 33% of the pay is covered by the employer, and 67% by the social security fund.

Other leave

- Marriage leave: If an employee gets married, they are entitled to five paid days for their wedding.- Bereavement leave: Employees are entitled to three days’ paid leave for the death of a spouse, parent, or child.
