Note that we are busy building our own entity in Nepal to provide you with the best possible employment solutions for your employees, but our employer of record service is not yet live in this country.

To employ in Nepal, companies must own a local legal entity in the country or work with a global employment solution. Developing the processes required to manage payroll, benefits, taxes, and onboarding in countries like Nepal can get complicated fast, especially without localized expertise.

If you're looking to start hiring in a country like this, partnering with a global employment solution like Remote makes it easy for your company to employ workers quickly, cost-effectively, and in full compliance with all local legislation.

In the countries where we do offer our EOR services, Remote takes on the responsibility and legal risks of international employment so you can focus on hiring great talent and growing your business.

Risks of misclassification

Nepal, like many other countries, treats self-employed individuals or contractors and full-time employees differently. Misclassification of contractors in Nepal may lead to fines and penalties for the offending company.

Employing in Nepal

Workers' rights in Nepal are protected by:

  • The Nepalese Constitution of 2015

  • The Labour Act of 2017

  • The Social Security Act of 2018

  • The Nepalese Trade Union Act of 1992

— all of which guarantee equal pay for equal work, the right to individual and collective labour disputes, safe working environements, and protections against discrimination based on age, religion, and race.

Common questions that could come up during the hiring process include the minimum wage, overtime rates, and guaranteed paid time off. Remote can help you offer a complete, competitive, and compliant benefits package to your employees in Nepal.

Minimum wage

Nepal’s minimum wage is fixed at NPR 15,000 ($121) per month although skilled employees will negotiate rates on a case-by-case basis which will tend to be higher than the minimum wage.

Types of leave

Workers are entitled to one day’s paid vacation for every 20 days worked. That ranges between 12.5 days off a year (five days a week, 250 days a year) and 15.5 days (six days a week, 310 days a year).

Employment termination

Termination process

Employers can dismiss employees for poor performance, conviction for a criminal charge, medical incapacity, the expiration of their contract, or serious misconduct such as getting violent at work, fraud, theft, taking unapproved leave of up to 30 days, and falsifying documents.

Employees should generally be notified of a pending termination at least seven days in advance so they can offer an explanation for their behaviour; on the other hand, terminations for misconduct are effective immediately.

Notice period

The notice period depends on how long an employee has been working:

  • Up to four week: one day

  • From four weeks to one year: seven days

  • More than one year: 30 days

Severance pay

Nepali workers are only entitled severance payments if they’re not eligible for unemployment benefits, in which case the employer has to pay the employee a month’s salary for every year they’ve been employed.

Upon dismissal, an employer must pay the employee the cash value of any unused leave they’ve accrued.

Probation periods

Limited to six months.
