Medical leave of absence

Medical leave is a vital employee benefit that supports the health and well-being of your workforce.

What is medical leave of absence?

A medical leave of absence is a designated period of time off that is granted to an employee for health-related reasons.

It allows them to take the necessary time to recover from a medical condition, undergo medical treatments, or care for a sick family member without the risk of losing their job. Employers may offer medical leave as a part of their employee benefits package, or in compliance with legal requirements.

What is paid medical leave of absence?

Paid medical leave is a type of medical leave where the employee continues to receive their pay (or a portion of it) while away. In some locations, including most of Europe, paid medical leave is required by law. 

In locations where it isn’t, employers may opt to provide paid medical leave as an employee benefit, usually with conditions.

How does medical leave work?

The process for administering medical leave depends on a variety of factors, including what the local laws and regulations are, and the employer’s own policies. Generally, though, it looks something like this:

  • Eligibility. The first step is usually to determine eligibility. This can vary based on company policy, employment contracts, and local labour laws, but typically, employees must have worked for the company for a certain period (or meet specific criteria) to qualify for medical leave.

  • Duration. The duration of the leave can vary depending on the employee’s medical needs and company policy. It may range from a few days to several weeks or even months. In some jurisdictions, there are laws that provide specific guidelines on the duration and conditions for medical leave.

  • Documentation. Employers often require documentation from a healthcare provider to verify the need for medical leave. This documentation helps ensure that the leave is justified and assists in planning for the employee’s absence.

  • Job protection. Many laws and company policies provide job protection during medical leave, ensuring that employees can return to their position (or a similar one) once they are able to work again. This protection helps employees feel secure in taking the necessary time off for their health.

Employers should always have clear, written policies regarding medical leave that cover these areas, and that are fully compliant with all relevant laws.
