Employment termination in Kosovo

Termination

Employers must have due reason to terminate an employee, as well as provide written notice. Employment agreements cannot be terminated during maternity leave, pregnancy, or leave for special care of a child.

Severance pay

Severance pay is due based on the length of service of the employee with the company.

For indefinite contracts:

  • At least two years but less than four years: one month’s salary

  • At least four years but less than ten years: two months’ salary

  • At least 10 years but less than 20 years: three months’ salary

  • At least 20 years but less than 29 years: six months’ salary

For fixed term contracts:

  • At least 3 years: one month’s salary

  • At least 5 years: two months’ salary

Terminated employees must receive any accrued but unused annual leave pay.



Notice period

Employers can provide written notice for termination, as follows:

  • For definite-term contracts: 30 days

  • For indefinite contracts between six months and two years: 30 days

  • For indefinite contracts more than two and ten years: 45 days

  • For indefinite contracts of more than ten years: 60 days

Probation periods

The maximum allowed length of probation periods is six months. During this time, either party can terminate the contract with seven days notice.
